AN URGENT REQUEST FOR ACTION FROM 

Legislation is currently moving that would close the online sales tax loophole, creating revenue that potentially could be targeted toward reducing the commercial rent tax. Florida is one of only two states that doesn't require out-of-state online retailers to collect and remit sales tax on online purchases; as a result, Florida businesses are essentially penalized, and out-of-state online retailers receive a competitive advantage. Senate Bill 50 and House Bill 15 would fix this loophole.

Of particular significance for our industry, there has been discussion that the increased revenue generated by this fix could be used to help offset the commercial rent tax. SB50 is advancing quickly in the Senate, and now is the time to get our message in front of House leadership as they consider how to proceed. A sample message follows. SAMPLE LETTER TO LEGISLATOR

Dear (INSERT LEGISLATOR),

As a member of the Building Owners and Managers Association (BOMA) Florida, I am writing to request your support of House Bill 15--and its companion Senate Bill 50 – that proposes to eliminate the online sales tax loophole. Florida is one of only two states that doesn't require out-of-state online retailers to collect and remit sales tax on online purchases; as a result, Florida businesses are essentially penalized and out-of-state online retailers receive a competitive advantage.

Further, we would suggest that the revenue generated by passage of this legislation must be tied to tax reductions, and we urge that proceeds be used to reduce the commercial rent tax. Florida is the only state in the country that imposes sales tax on commercial real estate leases. This unfair tax hampers job creation slows economic development, subjects businesses to disproportionate regulatory burdens, produces instances of double taxation and again creates a competitive disadvantage for Florida compared to other states.

We believe that HB15 and SB50 present a unique and important opportunity to correct both the sales tax loophole and the longstanding problem of the commercial rent tax.
